These Terms and Conditions govern the residential care services provided by Calm Bower to residents and establish the agreement between residents, their families, and our facility. Please read these terms carefully before entering into a residence agreement.

1. Definitions

For the purposes of this agreement:

  • "Calm Bower," "we," "us," or "our" refers to the residential care facility located at 115/9 Thanon Phahonyothin, Mueang Chiang Rai, Chiang Rai 57000, Thailand
  • "Resident" refers to the individual receiving residential care services
  • "Family" or "Family Member" refers to designated emergency contacts and authorized representatives
  • "Services" refers to all care, accommodation, and support provided by Calm Bower
  • "Agreement" refers to the residence contract signed upon admission

2. Admission Requirements

2.1 Age and Capacity

Residents must be 18 years of age or older. The resident or their legal guardian must have the capacity to enter into this agreement.

2.2 Health Assessment

All prospective residents undergo a health assessment to determine appropriate care needs. Calm Bower reserves the right to decline admission if our facility cannot safely meet the individual's medical or care requirements.

2.3 Trial Period

A voluntary trial stay of one to two weeks may be arranged before committing to long-term residence. Either party may terminate during the trial period with 48 hours notice.

3. Services Provided

3.1 Included Services

All residence options include:

  • Furnished accommodation (shared or private as selected)
  • Three daily meals prepared on-site
  • Personal care assistance (bathing, dressing, mobility support)
  • Housekeeping and laundry services
  • Access to common areas, gardens, and walking paths
  • 24-hour staff presence

3.2 Additional Services

Cultural Program and Private Retreat options include additional services as detailed in the specific residence agreement.

3.3 Services Not Provided

Calm Bower does not provide advanced medical care, intensive nursing, or treatment for acute medical conditions. We coordinate with external healthcare providers for medical needs beyond our scope.

4. Payment Terms

4.1 Monthly Fees

Residence fees are charged monthly in Thai Baht and payable in advance by the first day of each month. Current rates are:

  • Mountain View Shared Residency: ฿12,800/month
  • Mountain Culture & Gentle Movement Program: ฿13,200/month
  • Hilltop Private Retreat Room: ฿76,000/month

4.2 Payment Methods

Payment may be made via bank transfer, cash, or check. Direct debit arrangements are available upon request.

4.3 Late Payment

Payments received after the 5th of the month incur a late fee of ฿500. Continued non-payment may result in termination of services with 30 days written notice.

4.4 Fee Adjustments

Calm Bower may adjust fees annually to reflect changes in operating costs. Residents and families will receive 60 days written notice of any fee increases.

5. Resident Rights and Responsibilities

5.1 Resident Rights

Residents have the right to:

  • Be treated with dignity, respect, and kindness
  • Privacy in personal spaces and health matters
  • Make decisions about daily routines and activities
  • Decline participation in any program or activity
  • Receive visitors during visiting hours (8:00 AM - 8:00 PM)
  • Access personal information and care records
  • Voice concerns or complaints without fear of retaliation

5.2 Resident Responsibilities

Residents are expected to:

  • Treat staff and other residents with courtesy and respect
  • Follow reasonable facility guidelines for safety and community well-being
  • Inform staff of changes in health condition or needs
  • Respect shared spaces and property of others
  • Ensure timely payment of fees or communicate financial difficulties promptly

6. Health and Medical Care

6.1 Care Coordination

Calm Bower staff assist with medication routines and coordinate appointments with external healthcare providers. We do not employ medical doctors but maintain relationships with nearby clinics and hospitals.

6.2 Medical Emergencies

In medical emergencies, staff will contact emergency services and designated family members immediately. Residents or families are responsible for medical costs incurred from hospital care or specialist treatment.

6.3 End-of-Life Care

Calm Bower respects advance directives and end-of-life wishes. Families are encouraged to discuss these matters and provide written documentation of preferences.

7. Visiting Policy

Visitors are welcome daily from 8:00 AM to 8:00 PM without advance notice. We ask that visitors:

  • Respect the quiet atmosphere maintained for all residents
  • Observe afternoon rest hours (2:00-4:00 PM) by keeping noise minimal
  • Not bring outside food or beverages without prior approval
  • Follow staff guidance if their loved one is unwell or requires rest

Family members are welcome to join meals with advance notice and a small contribution for food costs.

8. Termination of Services

8.1 Voluntary Departure

Residents or families may terminate residence at any time with 30 days written notice. Fees for the notice period remain payable.

8.2 Involuntary Termination

Calm Bower may terminate services with 30 days written notice if:

  • The resident's care needs exceed our capabilities
  • Behavior poses safety risks to staff or other residents
  • Payment obligations remain unfulfilled after repeated notices
  • Terms of this agreement are repeatedly violated

8.3 Refund Policy

Monthly fees are not refundable. If departure occurs mid-month, a prorated credit may be applied toward final expenses or returned to the family.

9. Liability and Insurance

9.1 Facility Liability

Calm Bower maintains insurance coverage for facility operations and staff conduct. We are not liable for losses resulting from resident choices made in exercise of autonomy, natural progression of health conditions, or circumstances beyond our reasonable control.

9.2 Personal Property

Residents are responsible for their personal belongings. While we provide lockable storage, we are not liable for loss or damage to personal items. Families are advised against bringing high-value items to the residence.

9.3 Recommended Insurance

Families are encouraged to maintain health insurance for residents to cover medical expenses from external healthcare providers.

10. Complaints and Dispute Resolution

10.1 Internal Resolution

Concerns or complaints should first be raised with the Residence Director. We commit to investigating all complaints within 14 days and providing a written response.

10.2 External Recourse

If resolution cannot be reached internally, matters may be referred to the Chiang Rai Elder Services Council or pursued through Thai legal channels as appropriate.

11. Governing Law

This agreement is governed by the laws of Thailand. Any disputes shall be resolved in the courts of Chiang Rai Province.

12. Changes to Terms

Calm Bower may update these Terms and Conditions to reflect changes in services, regulations, or operational practices. Significant changes will be communicated to residents and families with 60 days notice.

Continued residence after changes take effect constitutes acceptance of the updated terms.
